    • Terminate your account.

2.0 Joining Us

2.1 Account Creation and Eligibility:

  • To access certain features and services, you must create a user account ("Membership Account" or "User Account").

  • You must be an individual aged 18 and over, or an emancipated minor with parental/guardian consent.

  • By registering, you agree to these Terms & Conditions (T&Cs).

  • Accounts created on behalf of organizations require authorization to bind the entity.

2.2 User Responsibilities and Warranties:

  • Accurate Information: You agree to provide accurate, complete, and current information when registering and using Book Mama's services. This includes a valid email address for potential product/service identification.

  • Age and Legal Capacity: You represent that you have the legal capacity to enter into a binding agreement (of majority age in your jurisdiction).

  • Content Ownership: You warrant ownership or lawful rights to all content you upload, import, or share on Book Mama platforms, including designs, images, text, etc. ("User Content").

  • Third-Party Rights: You confirm your User Content doesn't infringe upon any third-party rights.

  • Lawful Content: You guarantee your User Content is truthful, accurate, non-infringing, and legal to use in your jurisdiction.

  • Consent for Personal Information: You confirm obtaining all necessary permissions for uploading personal information or likeness of others within your User Content.

  • Failure to this policy is a breach of the Terms, which may result in immediate termination of Your account on Our Website.

  • If you are registering on behalf of an organisation or company you must have the authority to bind that company.

  • By accepting these Terms and Conditions, you agree to waive, release, and hold harmless the Company from any claims resulting from any action taken by US during or as a result of its investigations and/or from any actions taken as a consequence of investigations by either the Company or law enforcement authorities.

  • You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise inaccurate, misleading, offensive, vulgar or obscene.

2.3 Subscription Purchases:

  • To purchase subscription products, you must register and create an account.

  • Required Registration Information:

    • Full Name

    • Valid Email Address

    • Delivery Address

    • Payment Method Details (Card, Apple Pay, PayPal, Clearpay)

    • Child(ren)'s Full Names and Birthdates (if applicable)

    • Additional Information for Tailored Services (optional, part of subscription process)

2.4 Email Marketing:

  • During registration/sign-up or through our website forms, you are automatically subscribed to Book Mama's email marketing ("Lit-Bits").

  • All subscribed users/members are eligible for discounted offers and services.

  • You can unsubscribe from emails using the provided link.

2.5 Account Information Accuracy:

  • You warrant that all information provided during account registration is true and accurate to the best of your knowledge.

  • You are responsible for keeping your account information updated.

2.6 Discount Code and Credit Usage:

  • We reserve the right to reject or reclaim discounts/credits deemed to be used in violation of these T&Cs.

2.7 Account Security and Responsibility:

  • You are responsible for all activity and purchases made under your account.

  • Immediately notify us at ask@bookmama.co.uk if you suspect unauthorized access or security breaches.

 

3. Purchase of Subscriptions and Subscription Boxes

3.1 Subscription Types:

  • Lit-tle Dragons Subscriptions: These are one-off purchases or recurring subscription plans with a bespoke customization service.

  • Lit-tle Dragons Bundles: These are collections of quality books offered as a one-time purchase or automatic recurring order.

3.2 Subscription Renewal:

  • Lit-tle Dragons Subscriptions automatically renew weekly, bi-weekly, monthly, or termly. Paid-in-advance 3 and 6-month options are also available.

  • If your subscription includes a discounted product price for the duration of a paid Subscription, once the period expires, your Subscription will automatically renew at the full Monthly Subscription product price.

  • Paid upfront subscriptions do not auto-renew and must be managed by the user. Subscriptions that have been paid for and delivered cannot be cancelled.

  • Subscriptions will automatically renew based on the selected preference at the end of the term unless cancelled.

  • Boxes are shipped according to the selected subscription plan.

3.3 Cancellation of Subscriptions:

  • To cancel the ongoing Lit-tle Dragons subscription service, termination must be made before the next renewal.

  • Paid-for subscriptions will be delivered and then terminated.

  • Refer to the Return Policy for information on returning unwanted items.

3.4 Order Confirmation and Amendments:

  • Orders are not accepted until confirmed on the Website and payments are cleared.

  • You may make changes to your order by calling or emailing us at Book Mama. Contact us via ask@bookmama.co.uk to amend orders.

 

4.0 Payments

4.1 General Information:

  • Pricing: Prices for all products (subscriptions and non-subscriptions) are displayed clearly on the website in GBP.

  • Payment Responsibility: You are responsible for keeping your payment information up-to-date to ensure uninterrupted service.

4.2 Subscriptions:

  • Payment Methods: We accept payments through a secure continuous payment authorization system.

  • Payment Cycle: You will be charged automatically based on the cycle chosen at your initial purchase (e.g, monthly, or quarterly).

  • Payment Failure: If a payment fails for any reason (insufficient funds, expired card, etc.), your subscription will be automatically cancelled. To resume deliveries, you will need to restart your subscription and update your payment details.

  • Bank Charges: We are not responsible for any bank charges associated with your subscription payments.

4.3 Fee Changes:

  • We reserve the right to adjust subscription fees at any time. We will provide you with written notification at least 28 days in advance of any price changes.

4.4 Authorization Check:

  • Upon registering for a subscription, restarting deliveries, ordering a one-off box, or updating your card details, we may temporarily authorize your card with a £1 charge. This is solely for verification purposes and will be immediately voided. However, some banks may temporarily reflect this charge on your account balance.

4.5 Non-Subscription Purchases:

  • Prices: Prices displayed for non-subscription purchases are in GBP and do not include UK VAT.

  • Estimated Shipping: Estimated shipping costs will be displayed for each delivery location during checkout.

  • VAT: Applicable VAT will be automatically added to the total amount due at checkout.

  • Payment Gateway: Payment must be made securely through our authorized payment gateway provider at the time of placing your order.

  • Third-Party Payment Gateways: You will submit your payment details directly to the chosen payment gateway provider. Please note that you may be subject to additional terms and conditions for using their service. We disclaim any liability arising from your use of these third-party services.

4.6 Payment Confirmation & Order Processing:

  • Full Payment Required: Full payment for your order (subscription or non-subscription) must be received before your order is dispatched.

  • Payment Information Accuracy: Please ensure all payment and address details are accurate to avoid delays or delivery issues. We are not responsible for orders held due to incorrect payment information or undelivered packages due to incorrect addresses.

 

5. Paid-in-Advance Gift-Based Subscriptions

5.1 General Terms Apply:

  • All Book Mama terms and conditions apply to Gift Subscriptions in addition to the following specific terms.

  • The following terms and conditions will also apply to the purchase and redemption of Gift Subscriptions on the Book Mama website.

5.2 Gift Subscription Options:

  • Gift Subscriptions are available in bundles of 3 or 6 months, delivered monthly.

  • You will receive a voucher code via email upon purchase.

5.3 Redemption:

  • Recipients redeem subscriptions by using the voucher code at checkout for the relevant product. Gift vouchers are valid for one recipient only and expire 12 months after purchase.

  • Gift subscriptions are non-refundable and cannot be replaced if lost or stolen. They cannot be redeemed in whole or in part for cash or used with other offers.  

  • It is your responsibility to safeguard your voucher codes. We will not issue refunds if used by a third party.

5.4 Delivery Options:

  • Electronic: Gift subscriptions can be delivered electronically to the recipient's email address you specify.

  • Physical Gift Pack: Physical Gift Packs with a Gift Code are available for an additional cost. The recipient is responsible for redeeming the Gift Subscription by entering the provided code.

5.5 Delivery Restrictions:

  • Before purchasing, ensure the recipient resides in mainland UK and can receive the products.

  • Contact us at support@bookmama.co.uk for inquiries about international shipping.

5.6 No Payment Details Needed:

  • Gift subscription redemption only requires recipient contact details and preferences.

  • There are no automatic renewals. New subscriptions can be purchased if desired.

5.7 Gift Pack Delivery:

  • If your Gift Subscription includes a gift pack, it will be delivered with the subscription box.

 

6. Subscription Order Cancellation

6.1 Legal Cancellation Right:

  • You have a 14-day period to return and receive a refund on your first subscription order.

6.2 Cancellation Methods:

  • My Subscription: You can cancel subscriptions anytime in the "MY SUBSCRIPTION" section of your account.

  • Email: Email a cancellation request to ask@bookmama.co.uk.

6.3 Cancellation Deadlines:

  • 14-Day Window: All prepaid subscriptions are subject to a 14-day cancellation period from receipt of the first box. Thereafter, subsequent subscription orders are not eligible for refunds under the 14-day return condition.

  • Mid-Cycle Cancellations: Subscriptions cannot be cancelled during the cycle of a Subscription. Cancellations can be made at any time before the renewal payment is taken. No refund will be issued for cancellations made after the fulfilment of the subscription commences.

6.4 Automatic Renewal:

  • You can cancel the automatic renewal.

  • Paid Subscriptions: If you've already paid for your next order or cancelled out of the payment cycle, that will be the final box you receive and no further charges will be made.

6.5 Outstanding Boxes:

  • Unfulfilled Subscriptions: If you haven't finished your paid Subscription term, outstanding boxes within the paid Subscription will be delivered as usual, but your subscription will not be automatically renewed.

6.6 Termination by Book Mama:

  • We reserve the right to terminate or restrict your use of our service for any reason, such as a suspected breach of these Terms and Conditions.

  • Termination would be immediate and may be without notice.

7. Discounted Offers

7.1 Promotional Offers:

  • We may offer marketing promotions with discounts for new customers.

  • You need internet access and valid payment details to redeem discounts.

7.2 No Obligation to Continue:

  • There's no obligation to continue past your first box, but you need to cancel future orders before your next billing date, which can be found in your account.

  • Your first box will ship within 5 business days of the order.

7.3 Promotional Codes:

  • First Order Only: A promotional code may be used for your first subscription order only.

  • Full Price Renewal: The next renewal payment will be taken at full price.

  • One Discount per Household: Introductory offers apply to one account per household and cannot be used with multiple accounts created by the same person.

  • Incompatible Discounts: Discounts and credits cannot be used with other offers unless explicitly stated. Promotional discount codes do not apply to 3 or 6-month Prepaid Subscriptions.

7.4 Post-Discount Charges:

  • You'll be charged the full price for boxes after your discounted offer ends.

  • We will continue to bill your chosen payment method until you cancel.

7.5 Single Child Offer:

  • The discounted offer applies to only one box.

  • Additional boxes for siblings will be charged the standard price.

7.6 Referral Program:

  • 7.6.1. Eligibility

    • This program is open to all existing Book Mama customers.

    • Referred friends must be new customers who haven't previously placed an order on Book Mama.

  • 7.6.2. Rewards

    • Referrer Reward: You (the referrer) will receive a "Double the Delight reward" coupon offering a 15% discount on your next order at Book Mama.co.uk. This discount excludes subscription purchases and has a minimum order value of £15 (after discount is applied). Only one "Double the Delight reward" code can be redeemed per order.

    • Referred Friend Reward: Your friend (the referred friend) will receive a "Book Mama's Book Buddies" coupon offering a 10% discount on their first order of eligible items at Book Mama.co.uk. This discount excludes subscription purchases and only applies to items bought directly on the website. Only one "Book Mama's Book Buddies" code can be redeemed per order.

  • 7.6.3. Referral Process

    • Share your unique referral link or code with your friends. You can find your referral link/code in your Book Mama account.

    • Your friend must use your referral link or code at checkout on their first order to be eligible for the "Book Mama's Book Buddies" discount.

    • Once your friend places a qualifying order using your referral link/code, you will receive your "Double the Delight reward" coupon via email.

  • 7.6.4. Program Conditions 

    • Both "Double the Delight reward" and "Book Mama's Book Buddies" coupons are only valid on Book Mama.co.uk.

    • These rewards cannot be combined with any other promotions or discounts.

    • Discounts are applied to the subtotal before shipping costs.

    • We reserve the right to modify, suspend, or terminate this program at any time without notice.

  • 7.6.5. Additional Information

    • You are responsible for ensuring your friend is aware of these terms and conditions.

    • Book Mama reserves the right to disqualify any referrals it believes are fraudulent or abusive.

8. Delivery:

8.1   Methods:

  • Subscription boxes are delivered via small or medium parcel options using Royal Mail or a courier service.

8.2  Tracking:

  • All orders are tracked, and proof of delivery obtained.

8.3  Delivery Times:

  • Estimated delivery times may vary depending on order volume, stock levels, delivery location, purchase timing, shipping cycles, and courier logistics. External factors can also impact delivery times.

  • Book Mama reserves the right to use alternative postage services without prior notice when necessary.

  • Delayed Deliveries: Book Mama is not responsible for delayed deliveries under any circumstances.

8.4  Lost or Undelivered Orders:

  • Reporting: For undelivered or lost subscription boxes, you must report the issue within 7 days of the dispatch date by emailing support@bookmama.co.uk.

  • Investigations: An investigation will be opened for undelivered boxes reported within 7 days of shipment. Replacement boxes will be sent based on the investigation's outcome.

8.5  Address Changes:

  • Responsibility: You are responsible for updating your account address to ensure deliveries go to the correct location. Update your address before the payment date to avoid non-refundable deliveries to incorrect addresses.

  • Account Termination: Book Mama reserves the right to terminate your account if they believe the postal service in your area is unreliable.

8.6  Returns and Refunds:

8.7  Recalled Goods:

  • Process: Book Mama reserves the right to recall faulty goods. Return them by mail to the business address for inspection.

  • If the fault is confirmed, a full refund will be issued for the returned goods. This right does not affect your legal rights.

8.8  General Returns Policy:

  • Return Window: You have 14 days from cancellation to return items in good, sellable condition for a full refund. Refunds will be issued within 14 days of receiving the returned item. Read full Return policy here: https://www.bookmama.co.uk/return-policy

8.9  Undeliverable Packages:

  • Correct Address: If delivery fails due to an incorrect address (on your end), Book Mama will inform you and attempt a refund or re-credit for the payment.

8.10 Attempted Delivery:

  • Missed Local Delivery Service: If no one is present to accept delivery at your address, you will be notified of an alternative delivery date or a collection location. Book Mama will attempt delivery twice before returning the package.

  • Missed Courier Delivery: If no one is present during courier delivery at your address, the courier will make redelivery attempts based on the services policy. You are responsible to ensure the receipt of your ordered parcel.

8.11 Delivery Timeframe:

  • Estimated Delivery: Book Mama will make every effort to deliver your order as soon as possible, typically within 30 days.

  • Cancellation and Refund: If delivery cannot be made within 30 days, you will be informed and have the right to cancel the order for a full refund or re-credit. Book Mama is not liable for any delays or damages caused by late deliveries.

8.12 Ownership and Risk of Loss:

  • Transfer of Ownership: You become the owner of the ordered goods and assume the risk of loss or damage once they are delivered to you.

 

Non-Subscription Orders

Delivery:

8.13 Methods:

  • Non-subscription orders are delivered through letterbox, small parcel, or medium parcel options using Royal Mail or a courier service.

8.14 Tracking:

  • All orders are tracked, and proof of delivery secured

8.15 Delivery Times:

  • Estimated delivery times may vary depending on order volume, stock levels, delivery location, purchase timing, shipping cycles, and external factors impacting delivery times.

  • Book Mama reserves the right to use alternative postage services without prior notice when necessary.

  • Delayed Deliveries: Book Mama is not responsible for delayed deliveries under any circumstances.

8.16 Returns:

  • Return Window: You have 14 days from the delivery date to return any item for a refund. Refund processing is at Book Mama's discretion.

8.17 Return Process:

  • You must inform Us about your return by emailing Us at support@bookmama.co.uk.

  • An electronic return form must be completed for returns.

  • The item must be returned in its original packaging and condition.

  • All postage costs associated with returns are the customer's responsibility.

8.18 Refunds:

  • Refunds for successfully returned products will be issued within 10 business days of arrival at the business address.

  • The refund will be processed in accordance with our return policy only and be credited to the original payment method.

8.19 School Deliveries:

  • Free postage promotions offered on our main website do not apply to orders placed during the school virtual fair. All school orders are processed after the close of the virtual fair and delivered directly to the school for collection/distribution.

 

9. Website Use

9.1 Prohibited Activities:

  • Uploading or transmitting any material containing viruses, malware, or code designed to harm the website or its users.

  • Interfering with the website's servers, networks, or underlying infrastructure.

  • Violating any network procedures, policies, or regulations.

11. Intellectual Property Rights

11.1 Website Ownership:

  • For intellectual property related to authors, books and materials we sell and distribute, intellectual property rights belong to the copy rights owner.

  • The website and its original content are Book Mama's exclusive property.

  • Users are granted a non-exclusive license to use website intellectual property rights within the scope of these Terms and Conditions.

  • Users do not acquire any ownership of Book Mama's intellectual property rights.

11.2 Copyright Infringement:
